The test is whether a person would have received the same treatment as any other employee
There should be
no discrimination in recruitment, promotion, training or other aspects of
employment
Employees must also be protected from harassment or victimisation by other employees. It is the Employer’s responsibility to ensure their protection and the Employer is liable for any discrimination.
The responsibility is on the Employer to disprove a claim of discrimination
by an Employee at an Employment Tribunal.
