Alternative Arbitration Scheme

This new scheme, which came into operation on 21 May 2001, is intended to enable Unfair Dismissal claims to be dealt with by an independent arbitrator instead of an Employment Tribunal. The aim is to provide a quicker, cheaper, more convenient and less intimidating route.  The arbitrators decision will be final and there will be no appeal procedure.  Literature is available from any ACAS office.

We do not believe it is being widely used.  We advise our subscribers to consult us before embarking on this route; it may be appropriate in some cases, but others will continue to demand a more vigorous defence.
